General Terms of Use

Use of Website will be governed by these Terms of Use (“TOU”)

  1. Your general use of the Website is subject to this TOU. Please note that by visiting, accessing, and using this Website, you will be deemed to have accepted the TOU and to be legally bound by the TOU. If you do not agree to the TOU, please do not visit, access, and/or use this Website.
  1. The TOU may be changed from time to time at the sole discretion of Sky Premium, and your continued use of the Website shall constitute acceptance of the TOU as may be revised from time to time. As such please regularly check the TOU.
  1. The use of specific parts of the Website and/or specific services found in the Website may be subject to further specific terms and conditions.

Ownership of Website and materials on Website

  1. This website is owned and maintained by Sky Premium.
  1. All materials on this Website (including information, images, videos, and text) (the “Materials”) are subject to copyright, trade mark, and other forms of intellectual property rights, and belong to either Sky Premium or their respective intellectual property right owners.
  1. You may only use the Materials, to the extent that the Materials are necessary for accessing the Website and the services provided on the Website by Sky Premium.
  1. You must first obtain the written permission of Sky Premium before you:
  1. Reproduce, republish, post, transmit, or otherwise distribute the Materials in any way.
  1. Modify or use the Materials for any purpose other than accessing this Website and the services provided on the Website by Sky Premium.
  1. The reproduction, republishing, posting, transmission, distribution, modification, or unauthorized use of the Materials will be a violation of the owner of the copyright and/or other intellectual property rights. You may face civil and/or criminal liability for such a violation.

Access to the Website and Content of the Website

  1. This Website may occasionally be taken off-line as and when deemed necessary by Sky Premium (including, but not limited to, for the purposes of website maintenance). Sky Premium may also at any time also deny or restrict access to this Website, without the need to provide any notice or reasons whatsoever for the denial or restriction.
  1. Sky Premium does not make any warranty that the Website shall always be accessible to you, or that your access will be error-free, uninterrupted, or that the Website and any files or other data downloaded from the Website will be free of all viruses and other harmful software.
  1. The Materials provided on this Website are provided on an “as is” basis, and Sky Premium does not, to the full extent permitted by law, make any warranty (express or implied) that the Materials are accurate, timely, merchantable, and/or fit for any particular purpose.  Sky Premium may change any or all of the Materials without any notice.

Sky Premium will not be responsible for any damage that you may suffer as a result of the use of this Website and the Materials, including any inability to access the Website, any reliance on the accuracy of the Materials, and any viruses or harmful software acquired as a result of accessing the Website and the Materials. 

Permitted use of this Website

  1. You may use this Website solely for viewing and accessing the services provided by Sky Premium on the Website. Any other unauthorized use may be denied or restricted by Sky Premium. This shall include, but is not limited to:
  1. the use of any computer program, algorithm or methodology (whether automated or manual), to access, copy, compile information, monitor any part of this Website, or to bypass the security measures of the Website.
  2. the transmission via or through the Website of any information, data, text, images, files, links, or software other than those in connection with the authorized use of this website and/or where required pursuant to a specific request from Sky Premium.
  3. the introduction to the Website of any virus, malicious programs, and/or harmful code (howsoever named).
  4. the impersonation via this Website of any person, including other registered users or an employee of Sky Premium.
  5. the violation of any personal or propriety right.
  6. acts of misrepresentation and/or fraud. 
  1. Sky Premium shall have the right at all times to delete or edit all material which it deems to come under one of the matters set out at paragraph 14 above, or that which is otherwise in appropriate.

  3. Personal and/or confidential information which you are not authorized to post, transmit or otherwise send;
  4. Spam;
  5. Material which infringes Intellectual Property Rights; and
  6. Information and/or material of a similar nature to the above.

Membership Terms and Conditions

Membership services available on www.skypremium.com.sg (the “Website”) subject to General Terms of Use (“TOU”)

Your general use of the Website is subject to the TOU. Please read the TOU carefully. Membership services which are offered on this Website shall also be subject to the TOU.

A. Membership Application

  1. Some parts of the Website will only be available to members (“Members”). You may submit an application to become a Member here:  [https://www.skypremium.com.sg/sg/membership/step1]https://www.skypremium.com.sg/sg/membership/step1. Please note that membership (“Membership”) will only be granted upon payment of the applicable Membership fee.
  1. Your submission of an application to become a Member indicates your offer to become a Member upon these Membership Terms and Conditions (the “T&Cs”) and the TOU applicable at the material time. Sky Premium reserves the sole and absolute right to accept such offer. If Sky Premium accepts such offer, we will notify you by sending an acceptance email to your registered e-mail address, upon which there shall be formed a binding agreement between Sky Premium and the Member upon these T&Cs. For avoidance of doubt, your submission of an application to become a Member shall be deemed as acceptance of these T&Cs.
  1. The T&Cs may from time to time be amended by Sky Premium without notice to you, and your continued status as a Member shall be deemed to be acceptance of any such amendment. Sky Premium may, at its discretion, inform you of material changes to the T&Cs. If you disagree with the T&Cs and/or any amendments made thereto, please terminate your membership immediately. Details on how to terminate your Membership are provided at paragraph 5 of section C below.
  1. When you submit an application to become a Member, you warrant and represent that all information provided in the application is accurate, complete, and current as of the date of application. Failure to do so may result in a rejection of your application, or where Membership has already been granted, the termination of your Membership, and/or the termination of any transaction involving Membership Benefits (defined below). Your responsibility to provide accurate information is a continuing obligation and you must notify Sky Premium in the event that any information provided by you has changed.
  1. The submission of your application shall also be deemed to be your consent to receiving email communication from Sky Premium for matters relating to, and arising from, your membership.

B. Membership Account

  1. Your Membership is personal to you. It is non-transferable and you may not use your Membership to obtain benefits on behalf of another person who is not a Member.  You are responsible for ensuring that no one else uses your Membership.
  1. Access to and use of the Members section of the Website via a user name and password is reserved exclusively for Members. You are solely responsible for maintaining the confidentiality of your user name and password and you agree to notify Sky Premium immediately if you believe that there has been any breach of security (e.g. the unauthorised use of your user name and password). You shall not at any time disclose your password to any third party.
  1. You will be issued a Membership card to allow you to access the various features of your membership. You agree that you will only use your Membership card for the purposes for which it is issued. You must notify Sky Premium immediately by e-mail if it is lost or stolen. The issuance of a replacement card by Sky Premium shall be subject to a replacement fee of $200.

C. Membership Fees, Termination, and Renewal

  1. Membership fees shall be communicated to you upon application and the annual Membership fee will be due within the next business day from the date of acceptance of your Membership application, and annually thereafter. Unless otherwise informed by you, Sky Premium will automatically renew your membership on a yearly basis. You will be contacted directly in order to renew your Membership when your Membership is due for renewal. All payments of Membership fees will be handled via credit card, in a manner in substance similar to Section F below.
  1. Your Membership fee is non-refundable. However, Sky Premium may at its sole discretion elect to refund your Membership fee in whole or in part depending on the circumstances relating to the termination of your Membership.
  1. Upon receipt of payment of the applicable Membership fee, Sky Premium shall issue/renew your Membership Card and other Membership documents (as may be necessary).
  1. Sky Premium reserves the absolute right to terminate or suspend your Membership (at its sole discretion) for any reason whatsoever, including but not limited to a breach of the T&C and/or where your Membership fee has remained due for a period of more than three months.
  1. If you wish to terminate your Membership, you may do so by providing 1 month notice via email to Sky Premium.
  1. In the event that your Membership is terminated, all provisions in the T&Cs pertaining to confidentiality, disclaimers, personal information, and indemnity and limitations of liability shall continue to apply. For the avoidance of doubt, the TOU shall continue to apply to your general use of the Website.

D. Membership Benefits

  1. As a Member, you will be able to access the Member Benefits (defined below) set out on the Website (including but not limited to discounts, preferential rates, and other perks). A dedicated membership hotline (during business hours) shall be provided to the Members for enquiries and booking of the services and benefits, the details of which shall be stated on the Website. 
  1. “Members Benefits” shall include:
  1. Access to the e-Store and the ability to purchase goods on the e-Store (collectively “goods”). Please see Part E and/or the relevant parts of the Website for the specific terms and conditions on the use of the e-Store.
  2. Access to services, including travel services provided by Sky Premium as a registered travel agent (collectively “services”). Please see the relevant part of these T&Cs and/or the relevant parts of the Website for the specific terms and conditions for such services; and
  3. Other benefits, including discounts at third party suppliers (collectively “benefits”). The details and terms of such benefits will be specified by Sky Premium on the Website and/or via email to you.
  1. You hereby acknowledge that some Membership Benefits are provided by third-party suppliers (“Suppliers”) and that the supply of such goods, services and/or benefits is subject to availability and may change from time to time without prior notice. The Suppliers may also have their own terms and conditions which may affect the availability and/or quality of the goods, services and/or benefits. Sky Premium shall not be liable for any Supplier’s lack of availability for the relevant Membership Benefits.
  1. For the purposes of giving you access to the goods, services and/or benefits provided by such the Suppliers, Sky Premium will generally communicate with the Suppliers on your behalf. However, there may be situations where it is more appropriate for you to contact the Suppliers directly, and Sky Premium will inform you when this is necessary.
  1. Sky Premium is committed to ensuring that the benefits remain available at all times. If any of the benefits become unavailable, we will do all we can to ensure that prior commitments with you are honoured to the fullest extent possible, but shall not be responsible for any actions of Suppliers.
  1. Sky Premium may from time to time discontinue Member Benefits. In the event that you are affected by the withdrawal of any such benefit, Sky Premium will inform you as soon as reasonably practicable.

E. Use of e-Store

  1. As a Member, you shall also have access to the e-Store on the Website. Without prejudice to the generality of the other provisions in the T&Cs, the provisions of this part shall apply to the use of the e-Store.
  1. Some goods on the e-Store will be sold directly to you by Sky Premium (“Sky Goods”). In the case of Sky Goods, you may place an order for such Sky Goods by providing the relevant details and clicking on the “purchase” or “buy” button to submit your order. Submission of an order is irrevocable and by doing so, you confirm that the details contained in your submitted order are correct in all aspects. If the order is confirmed, we will notify you by sending a confirmation email to your registered e-mail address, upon which there shall be formed a binding agreement between Sky Premium and the Member upon these T&Cs and such other specified terms for the sale and purchase of such Sky Goods. Notwithstanding the generality of the foregoing, Sky Premium reserves the right, at any time, to reject your order for any reason whatsoever.
  1. Some goods on the e-Store will be provided by Suppliers (“Supplier Goods”). In the case of Supplier Goods, you may place an order for such Supplier Goods by providing the relevant details and clicking on the “purchase” or “buy” button. Submission of an order is irrevocable and by doing so, you confirm that the details contained in your submitted order are correct in all aspects. If the order is confirmed, Sky Premium will send a confirmation email to your registered e-mail address, upon which there shall be formed a binding agreement between you and the relevant Supplier for the sale and purchase of such Supplier Goods.
  1. Sky Goods and Supplier Goods will be clearly marked as such on the Website.
  1. You acknowledge that while Sky Premium takes all reasonable efforts to ensure that the information in the e-Store is complete and reliable, the information may still contain typographical errors, omissions, pricing errors, and other errors or inaccuracies. For avoidance of doubt, any such errors, and/or inaccuracies shall not be binding. Notwithstanding the aforesaid, Sky Premium shall take all reasonable effort to correct any such errors and/or inaccuracies as soon as practicable.
  1. Goods may differ slightly from the images shown although every effort is made to ensure that all goods descriptions are as accurate as possible. In the case of Supplier Goods, the descriptions of such goods and services are provided by that Supplier. Sky Premium is not responsible for inaccurate or misleading goods descriptions provided by a Supplier.
  1. Sky Premium reserves the right to: (i) revoke any stated offer affected by such errors; (ii) correct any such errors; and (iii) make changes to prices, content, promotion offers, goods descriptions or specifications, or other information affected by the errors, without any obligation to issue any notice of such changes.
  1. In the case of Supplier Goods, you acknowledge and agree that your purchase of the same is always subject to the Supplier’s terms and conditions including such terms governing cancellation, exchange and/or refunds for your intended purchase and/or purchase.
  1. You acknowledge that Sky Goods purchased from the e-Store may be shipped to you via a third-party carrier, and that all risk of loss and title to the goods shall pass to you upon Sky Premium’s delivery of such goods to such third-party carrier. Unless expressly provided for, Sky Premium shall not be responsible for any damage, delay or loss of the goods during delivery arising from the actions of the carrier. For the avoidance of doubt, in the case of Supplier Goods, Sky Premium shall not be responsible for any damage, delay or loss of the goods during the delivery of such Supplier Goods to you.
  1. Goods purchased from the e-Store may also be delivered to you via alternative means (e.g. self-collection). Where applicable, such alternative means will be specified directly on the relevant page of the e-Store, and your purchase of the good shall be deemed to be acceptance of such alternative means of delivery.
  1. Each completed purchase on the e-Store may make you eligible to receive reward points (“Sky Dollars”), which may be used to obtain certain rewards, the details of which shall be specified from time to time by Sky Premium. Sky Dollars are not transferable or refundable and cannot be combined with Sky Dollars belonging to other persons. You may not, at any time, purchase, sell or barter any Sky Dollars to any person in exchange for cash. Sky Dollars are also not redeemable for cash.
     
  2. One Sky Dollar equal to One Singapore Dollar value, and can be redeemed by Member to offset Sky Premium e-Store payment amount. Sky Dollars currently cannot be used to offset payments for hotel bookings.
     
  3. For e-store purchase, Sky Dollars are credited into the Member’s account within 2 calendar weeks after delivery.
     
  4. For hotel booking, Sky Dollars are credited into the Member’s account within 1 calendar week after hotel checkout.
     
  5. All earned Sky Dollars will expire 1 year from the date of accrual. For example, 100 Sky Dollars credited to an account on 16th March 2019 be expired on 15th March 2020.
     
  6. Sky Dollars is valid for the country where your membership is registered and available for usage under its currency.
     
  7. Sky Dollars are awarded based on the amount spent on the Company’s listed services and/or products, excluding taxes, special Gift Voucher purchase, credit card charges, administrative charges or the like.
     
  8. Sky Dollars will not be reinstated or extended under any circumstances once expired.
     
  9. Upon membership expiry, Sky Dollars in the account will be immediately void.
     
  10. Sky Dollars will only be rewarded to valid Sky Premium member and only valid member with active membership account can use the Sky Dollars under own account.
     
  11. Sky Dollars are only rewarded and operated by Sky Premium and Sky Premium has the full discretion on rewarding, revoking and forfeiting Sky Dollars.
     
  12. Sky Premium reserves the right to revise, suspend, or terminate any promotional event or discount without further notice.

F. Payment and Use of Credit Card

  1. Unless otherwise provided for, all payments made in connection with your Membership (including payments for purchases on the e-Store, and the use of Sky Premium's travel services, and restaurant services) shall be by way of credit card and shall become due upon confirmation of your order by Sky Premium or the Supplier (as the case may be).
  1. You shall only use your own credit card for purchases on the e-Store.
  1. If you have requested and authorised Sky Premium to use your credit card for payment, you acknowledge and agree that Sky Premium shall have no liability or be responsible in any way whatsoever in respect of the use of your credit card provided that Sky Premium acts in accordance with the instructions issued by you in relation thereto.
  1. You undertake that all details you provide to us for payment are correct, that the credit card you are using is your own, and that there are sufficient funds to cover the cost of the good or service. Sky Premium shall, to the extent possible under the law, not be responsible for any loss or damage arising from fraudulent transactions involving your credit card. Sky Premium expressly reserves the right to immediately cancel, delay, or recall any good, benefit, or service if there is reason to believe that it is a fraudulent transaction.
  1. Sky Premium may, at your order, purchase goods or services on your behalf. In such an event, you hereby authorise Sky Premium to deduct the credit sum (inclusive of any applicable fees) from your credit card within 30 days of the date of payment for the relevant goods or services.
  1. In the event that you have ordered a service which is supplied by a Supplier, Sky Premium does not guarantee and shall not be responsible for any refunds should such services be cancelled.
  1. You acknowledge that the price of certain goods offered on the e-Store is an estimate only (e.g. where certain goods are affected by seasonal pricing), and that the actual price of the good may be different. Such goods will be clearly marked on the e-Store as having estimated prices only. Where you have agreed to purchase the good based on its estimate price, you acknowledge that you have further agreed to authorize Sky Premium to deduct the full actual price from your credit card provided that the actual price is not 20% greater than the estimate.

G. Travel Related Services

  1. Without prejudice to the generality of the other provisions of the T&C, the provisions of this part shall apply specifically for travel related services provided by Sky Premium.
  1. Sky Premium is a licensed travel agent (travel agent licence number: 02887). However, any services including travel tickets and package holidays purchased through Sky Premium will be subject to the terms and conditions of the relevant travel services Supplier. For the avoidance of doubt, the terms and conditions for cancellation of and changes to bookings and purchases will vary for each Service, and therefore you are advised to check with Sky Premium with regard to any cancellation fees and the terms and conditions under which you are liable to pay the cancellation fee.  All rights and remedies you have are against the relevant Supplier.
  1. Sky Premium will communicate with the travel or holiday operator and the Supplier on your behalf unless it is more appropriate for you to contact the Supplier directly. However, please note that a minimum of 3 business days will be required, in addition to any time period required under the terms and conditions of the Supplier, relating to any booking cancellation and booking changes through Sky Premium.
  1. When you purchase any travel related services, you hereby authorize Sky Premium to charge your credit card in accordance with the terms and conditions relating to payment and the use of your credit card as set out at Section F above.
  1. You are advised to purchase the necessary travel insurance against any failure/disruption in the provision of the travel related service.
  1. Sky Premium reserves the right to assist and facilitate any request by the relevant authorities to ensure that all relevant laws and regulations are complied with, including the right to cancel, change or modify any travel tickets and package holidays purchased through Sky Premium or the right to provide information regarding such travel tickets and package holidays purchased through Sky Premium to the relevant authorities.

H. RESTAURANT AND CLUB SERVICES

  1. Without prejudice to the generality of the other provisions of the T&C, the provisions of this part shall apply specifically for restaurant and club services provided by Sky Premium.
  1. When you use the restaurant booking services on the Website, you may be required to provide your credit card details to secure the reservation. By submitting your credit card details, you hereby authorise Sky Premium and/or the relevant Supplier to charge your credit card accordingly for the reservation, inclusive of any cancellation charges that may arise, in accordance with Section F above.

I. TICKETS

  1. Without prejudice to the generality of the other provisions of the T&C, the provisions of this part shall apply specifically for tickets which may be offered to Members.
  1. Sky Premium is engaged in the business of providing Members with tickets for events either directly or through one of its ticket agent partners. Please note that you are purchasing tickets above face value, which includes service charge(s) reflecting our costs and efforts in obtaining your seats (all sums above the face value shall be henceforth referred to as “non-face value”).
  1. All sales are final, and no refunds or cancellations will be issued after you have purchased your tickets. When you purchase any tickets from or via Sky Premium, you hereby authorise Sky Premium to charge your credit card accordingly for the tickets, inclusive of any charges that may arise, in accordance with Section F above.
  1. In the event of show cancellations directly by the artist/promoter, Sky Premium will make best efforts to obtain a refund from the artist/promoter of the face value of the ticket on your behalf. Please note that the non-face value of the ticket is not refundable. Notwithstanding the generality of the foregoing, refunds (if any) shall be made only at the artist/promoter/ticket agent’s discretion and Sky Premium shall not bear any liability in the event that the artist/promoter/ticket agent’s does not offer a refund.
  1. The purchase of tickets is subject to the relevant terms and conditions of the ticketing agents.
  1. Self-collection of tickets is available for the Members. Alternatively, the Members may opt for the dispatch of tickets via registered post, at the Member’s own cost. Sky Premium will not be liable for any loss through delivery by post. 
  1. Sky Premium and its ticket agent partners reserve the right to upgrade tickets at no additional cost, to downgrade tickets (partial refund) or to cancel the order with a full refund.

J. Return Policy

  1. Unless explicitly provided otherwise, there shall be strictly no return and no refund for the purchase of tickets; goods that are perishable; goods which are made to your specification or are clearly personalised for you; intimates, earrings and undergarments; and/or any other goods which may be specified on the e-Store as being non-returnable and/or non-refundable.
  1. Goods which are received defective; received in a damaged condition; or which have been incorrectly delivered (i.e. where a different good from the good that was ordered has been delivered) may be returned, subject to the following terms and conditions:
  1. You must inform Sky Premium within 7 days in the event that the good has been received defective, damaged, or incorrectly delivered. In you do not do so:
  1. In the case of Sky Goods, Sky Premium will assume that you have received the goods in a state that conforms to the description of the Sky Good on the Website.
  1. In the case of Supplier Goods, you may be asked to communicate directly with the Supplier for the Supplier to process any returns request.
  1. In the case of Supplier Goods, the costs of returning the goods shall be the responsibility of the Supplier. Sky Premium will bear the costs of returns of Sky Goods. For the avoidance of doubt, Sky Premium shall not be obliged to bear the costs of returns for Sky Goods that are found to be not eligible for returns, and in such an event, you may be asked to reimburse Sky Premium for any postage incurred.
  1. Goods must be in their original purchase condition, including the original packaging, manufacturer's containers, documentation, and all accessories. All packaging must be unmarked and not defaced in any manner.  
  1. Any goods that you received with tag(s) attached must be returned with the same tag(s) intact.
  1. Goods purchased as part of a set or multi-item pack have to be returned as a whole set.
  1. All returned Sky Goods will be reviewed by Sky Premium. Goods should also match the written or photographic documentation of their condition provided when requesting the return. Returned Sky Goods that do not meet the requirements set out at (a.) to (e.) will not be accepted and customers may be charged for any expenses incurred by Sky Premium.
  1. In the case of Supplier Goods, all returns shall be subject to the ultimate final approval of that Supplier. Sky Premium will make reasonable efforts to assist you in obtaining the approval of the Supplier for a refund.
  1. Sky Premium reserves the right to offer, in lieu of a replacement Sky Goods, a refund in the form of Sky Dollars or cash, at our sole discretion.
  1. Any request for a return of Sky Goods shall take approximately 10 business days after receipt by Sky Premium of the Sky Goods to be processed. In the case of Supplier Goods, the processing time will depend on the Supplier.

K. Use of your Personal Data

  1. With the submission of your registration as a Member, you hereby consent that Sky Premium may collect, use and disclose your personal information, as provided in the application form, for the purposes of processing your Membership application, of administration of your Membership with Sky Premium, to contact you to provide goods and services that you requested and to inform you about Sky Premium related goods, services, offers and events and to contact you for post service feedback after utilization of Sky Premium related services.

L. Reservation of Liability

  1. Sky Premium warrants to you that Sky Premium shall use its reasonable endeavours to provide the membership services with reasonable care and skill, and as far as reasonably possible, in accordance with your request and instructions. In relation to goods or services provided by a Supplier, Sky Premium is acting as your agent in sourcing the goods or services. Sky Premium will use reasonable care in selecting the Supplier and ensuring the order is placed in accordance with your wishes. Sky Premium does not and will not provide any representations in relation to any information and suggestions on the Website which has been provided by third parties (e.g. Suppliers). You are deemed to be responsible for, and shall use your own skill and judgement as to, the quality, value and suitability of such information and suggestions in relation to deciding whether to enter into any contract with any Supplier for the supply of services or sale of goods.
  1. In the event where Sky Premium has assisted you to obtain goods or services supplied by a Supplier, your contract for the purchase of goods or services is made with the relevant Supplier only, and unless expressly provided otherwise, all your rights and remedies are against the Supplier. You agree that any contract entered into by you with any of the Suppliers is an independent contract. Sky Premium hereby disclaims any and all liability for any act or omission of any Supplier or any loss incurred by you as a result of any act or omission of a Supplier whether or not arranged through Sky Premium.
  1. Sky Premium will however do everything it reasonably can to assist you in any dealings you have with the Supplier.
  1. Sky Premium accepts no liability for any losses or claims arising from any inability to access the website or any failure to complete a transaction.
  1. Save in respect of death and personal injury caused by the negligence of Sky Premium or as expressly provided for in these Terms and Conditions, Sky Premium shall not be liable for any loss, cost, expense or damage of any nature whatever including (without limitation) compensatory, director, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties resulting from or arising in connection with any access to, use of, inability to use this Website, the provision of Member Benefits (including but not limited to the sale and purchase of Sky Goods and Supplier Goods), or your reliance upon the information and suggestions within the Website.
  1. Without affecting the generality of paragraph 5 above:
  1. Sky Premium shall have no liability to you for any loss, damage, costs, expenses or other claims for compensation arising from requests or instructions supplied by you which are incomplete, incorrect or inaccurate or arising from the late arrival or non-arrival of such requests or instructions, or any other fault of you.
  1. Sky Premium shall have no liability to you for any loss, damage, costs, expenses or other claims for compensation arising from requests you place for non-Members.
  1. In addition, non-Members shall have no cause of action directly, or indirectly via the Member or other person(s), against Sky Premium for any loss, damage, costs, expenses or other claims for compensation arising from requests placed for the benefit of the non-Member by a Member.
  1. Sky Premium shall not be liable to you or be deemed to be in breach of these Terms and Conditions by reason of any delay in performing, or any failure to perform, any of Sky Premium’s obligations in relation to the Services, if the delay or failure was due to any cause beyond Sky Premium's reasonable control.
  1. In any event, Sky Premium’s maximum liability to you for breach of any of its obligations hereunder shall be limited to the value of the annual Membership fee and the charge for the Member Benefits to be provided.
  1. Paragraphs 1 to 7 of this Section L shall apply only to the extent permitted by law.

M. Applicable law and jurisdiction

  1. These T&C and your Membership with Sky Premium are governed by the laws of Singapore and parties agree to submit to the exclusive jurisdiction of the Singapore courts.
  1. The provisions of the "Privacy Policy" and the TOU of the website, both as set out in the website, shall apply at all times.

N. Communication on Membership matters

  1. You may contact Sky Premium via email at membersg [at] skypremium.com.sg, via telephone at 6533 0000, or via post at “Sky Premium International Pte Ltd 1 Raffles Place Tower 2 #38-61 Singapore 048616” on matters concerning your Membership.
  1. When communicating with Sky Premium, please ensure that such communication is in compliance with paragraph 17 of the TOU.
  1. Sky Premium may provide Members with the ability to send messages to other Members and/or post messages on the Website. Please note that Sky Premium may, but shall not be obliged to, monitor, moderate, edit, or remove any or all such messages, and that Members are ultimately solely responsible for the matters which they have posted or sent. Members shall ensure that any message so posted or sent shall be in compliance with paragraph 17 of the TOU. In addition to paragraph 17 of the TOU, you shall also not post any confidential information belonging to Sky Premium, its parent, subsidiaries or affiliates.
  1. Sky Premium may contact you via email, post or telephone. If you have provided us with your mobile phone number, please ensure that it is a text messaging-enabled device in order to receive text messages from us.

O. Wavier

  1. Any delay or omission to enforce any right or provision of these T&Cs will not be considered a waiver of those rights.

P. Severability

  1. If any provision of these T&C is held to be invalid or unenforceable by a court, the remaining provisions of these T&C will remain in effect.

Q. Whole Agreement

  1. These T&C constitute the entire agreement between you and Sky Premium regarding your Membership, and the use of the services on the Website, and, unless specified otherwise, supersede and replace any prior agreements between you and Sky Premium regarding these Membership services.

 

 

SKY PREMIUM INTERNATIONAL PTE LTD (“SKY”) PRIVACY POLICY

SKY PREMIUM (hereinafter referred to as the “Club”/”us”/”we”) collects, uses, and discloses Personal Information (as defined below) of Users (as defined below) of the Club’s services and website, in order to provide a seamless and efficient experience with the Club. This Privacy Policy sets out how the Club will collect, use, and disclose Personal Information, and the measures that the Club will have in place to ensure the security of the Personal Information.  

1.    Definition of Personal Information and User 

“Personal Information” means information, whether true or not, about an individual who can be identified from that data or from that information to which the organization has or is likely to have access.  

“User” or “you” means an individual who has (a) contacted the Club through any means to find out more about the services provided by the Club; or (b) may, or has, entered into a contract with us for such services (including any persons who may, or has, applied for and/or obtained membership with the Club).

2.    Purposes to Use Personal Information

The Club may collect, use, and/or disclose your Personal Information for the following purposes:

a)    introducing and providing products and services of the Club to you;
b)    processing/confirming your orders and any changes to your orders, including (where necessary) the use of your credit-card information in order to complete an order;
c)    answering your inquiries;
d)    requesting that you provide your opinions and feedback about the Club’s services and products; 
e)    gathering statistics for marketing, promotion and product planning;
f)     gathering information for training and quality control purposes (including the recording of telephone calls between you and the Club).
g)    providing after-sales services, and contacting you after the delivery of products;
h)    coordinating with, or engaging a third party service provider that has business ties with the Club in order to provide products and services to you;
i)    maintaining and operating the Club’s website; 
j)    implementing system maintenance of the Club’s databases; and
k)    conducting any other commercial tasks related to, necessary for, or in connection with the above purposes.

3.    Consent

a.    Deemed Consent

i.    If you choose to use the Club’s services, or the Club’s website, or if you choose to make any inquiries to the Club, you are deemed to have consented for your Personal Information to be collected, used, and disclosed for the purposes set out at paragraph 2 above.   

ii.    The Club may also separately contact you regarding purposes which are not covered in this Privacy Policy. In such an event, the Club will only collect, use, and disclose your Personal Information to the extent that you have consented to. 

b.    Withdrawal of Consent

i.    You may withdraw your consent at any time by giving written notice to the Club. Please note that if you withdraw your consent, it may no longer be possible for us to provide to you the same services and products as before. 

ii.    If the Club receives written notice from you that you wish to withdraw your consent, the Club will inform you on how the withdrawal of consent might affect the products and services being provided to you. 

iii.    Please also note that the withdrawal of consent also does not affect any other legal consequences arising from the withdrawal. As such, where it is no longer possible for the Club to provide services to you, your withdrawal may result in early termination fees (only where applicable). 

iv.    If you nevertheless confirm that you wish to withdraw your consent, the Club shall within a reasonable time cease to collect, use, or disclose the Personal Information. Please note that the Club may require up to 30 working days for a request for withdrawal of consent to be fully reflected in our systems.

c.    Collection, Use, and Disclosure of Personal Information without consent

While the Club will generally only collect, use, or disclose your Personal Information with your consent (deemed or expressed), please note that the Club is legally permitted to collect, use, or disclose your Personal Information without your consent in certain situations, including:

i.    Collecting your Personal Information which is publicly available; 

ii.    Using your Personal Information for any purposes which are clearly in your interests; and

iii.    Disclosing your Personal Information where it is necessary for any investigation or proceedings, or where disclosure is required by law. 

4.    Access

a.    You may contact the Club and request for access to your Personal Information, and the Club will, within a reasonable time, provide such access. Please note that there may be exceptional situations where your access may be limited by law or may be subject to the discretion of the Club. This includes situations where:

i.    Access will be prohibited where the Personal Information will reveal personal data of another individual; or

ii.    Access will be at the discretion of the Club where the Personal Information is subject to legal privilege.  

b.    The Club may, to the extent permitted by law, charge a reasonable processing fee for the access to your Personal Information. 

5.    Accuracy and Correction

a.    The Club will take reasonable efforts to ensure that your Personal Information is correct and updated.  You may at any time contact the Club to update your Personal Information, and the Club may also from time to time request Personal Information updates from you.  

b.    You may also contact the Club and request for any errors or omissions in your Personal Information to be corrected, and the Club will, within a reasonable time, make the necessary corrections. 

c.    Please note that there are exceptional situations where the correction of Personal Information may be limited by law, or subject to the discretion of the Club. This includes situations where the Personal Information relates to opinion data kept solely for an evaluative purpose.

6.    Security and Care

a.    The Club is committed to ensuring that your Personal Information is secure. As such, the Club will take reasonable technical safeguards against the loss, corruption, or unauthorized access of your Personal Information. This includes regular maintenance and upgrading of information technology security systems and other similar measures. 

b.    The Club will also take reasonable steps to put in place the necessary procedural and organisational safeguards against the loss, corruption, or unauthorized access of your Personal Information. This includes providing training for our employees and other similar measures. 

7.    Disclosure of Personal Information to Third Parties 

a.    As mentioned above the Club may disclose Personal Information (in whole or in part) for the purposes set out at paragraph 2. 

b.    The Club regularly conducts rigorous and detailed evaluations of the personal information management abilities of our third party service providers, and also exercises the necessary and appropriate supervision of such third parties to ensure that they are able to provide a degree of protection over your Personal Information which is equivalent to this Privacy Policy. 

c.    The Club may also, transfer, store, and/or process your Personal Information in a country or territory outside of Singapore. We will however take appropriate steps to ensure that the overseas entity receiving your personal data is under a legal duty to provide a standard of protection to your Personal Information which is equivalent to the level of protection under the laws of Singapore. 

8.    Retention of Personal Information

a.    The Club will only retain your Personal Information where it is necessary to serve the purposes set out above, and where retention is necessary for legal or business purposes. 

b.    Where the purposes are no longer being served by the retention of the Personal Information, and where retention is no longer necessary for legal or business purposes, the Club will take reasonable steps to cease to retain the Personal Information, including the sanitization (for digital information) or destruction (for information in a physical form) of your Personal Information. 

9.    Use of Cookies

a.    The Club’s website may use cookies (and other related technologies). A cookie is a small data file sent by the website to the browser to your PC.  The cookie is used to store and track information about you when you use the Club’s website, such as the frequency of use, the pages visited, and your preferred pages.  This cookie will not be able to read data off your hard disk. 

b.    You can suspend cookie functions by changing the personal settings on your web browser (most web browsers will automatically accept cookies, but you should be able to modify the settings to decline cookies).  However, please note that you might not be able to fully use some parts of this website if you disable the usage of cookies.

10.    Amendments to Privacy Policy

The Club may from time to time amend this Privacy Policy without notice, and the updated version of the Privacy Policy can be found on the Club’s website.

11.    Limitations

This Privacy Policy sets out the steps that the Club will put in place to ensure the security of the Personal Information.  The Club will not be liable for any damages (including indirect damages, special damages, consequential damages and incidental damages) caused by unauthorized access of the Personal Information arising from your own actions, including but not limited to careless handling of your password and/or membership information.
